Dallas Employment Lawyer: The Attorney-Client Privilege

The attorney-client privilege protects confidential communications between a client and an attorney when those communications are made for the purpose of securing legal advice. The privilege enables a client and his attorney to speak frankly and honestly. In a lawsuit, the client will not need to reveal to the adverse party any correspondence or conversations the attorney-client privilege applies to.

The privilege, however, is not as broad as some people may think. For one thing, it does not protect underlying facts from disclosure. So, for example, an executive subject to a non-compete agreement will be obligated to discuss any competitive actions that he took; merely disclosing the activities to his attorney will not protect them from disclosure to the adverse party. The privilege also applies only when the client seeks legal advice; a company cannot protect its internal emails simply by copying corporate counsel on them. Finally, the privilege only applies to confidential communications; if the client forwards an email from his attorney to a group of associates, the privilege will no longer apply.
