Fifteen Enforcement Orders Served on Food Businesses in May

The Food Safety Authority of Ireland (FSAI) today reported that fourteen Closure Orders and one Prohibition Order were served on food businesses during the month of May for breaches of food safety legislation, pursuant to the FSAI Act, 1998 and the EC (Official Control of Foodstuffs) Regulations, 2010. Thirteen of the Enforcement Orders were issued by environmental health officers in the Health Service Executive and two by veterinary inspectors in the Department of Agriculture, Food and the Marine.

Four Closure Orders were served under the FSAI Act, 1998 on:

  • Voujon Café, 2 Terminus Villas, Turkey Road, Tramore, Waterford
  • Jackson’s Restaurant and Guesthouse, The Square, Roscommon
  • Dragon Taste (restaurant), 386 South Circular Road, Dolphins Barn, Dublin 8
  • Mr Ivan Ebbitt (unapproved food premises), Erne Hill, Belturbet, Cavan

Ten Closure Orders were served under the EC (Official Control of Foodstuffs) Regulations, 2010 on:

  • The Palm Tree (restaurant), Friar Street, Thurles, Tipperary 
  • Cloughjordan House (restaurant) (closed activity: ceasing use of the private water supply to the food business), Cloughjordan, Tipperary 
  • Trim and Healthy (health food shop) (activity closed: the decanting of foodstuffs in the premises), 3 Haggard Court, Haggard Street, Trim, Meath 
  • Swords Manor Take-Away, Manor Mall Shopping Centre, Brackenstown Road, Swords, County Dublin
  • Chilli Kebabish (take away), 15 Ellen Street, Limerick
  • Brosna Lodge Hotel (closed area: kitchen and associated areas), Main Street, Banagher, Offaly 
  • Jai Ho (restaurant), Hibernian Way, Mallow, Cork 
  • John Doyle’s Bar (closed activity: production of ice in the basement ice machine), 160 Phibsborough Road, Phibsborough, Dublin 7
  • Starry Kitchen Ltd (restaurant), 110 Upper Drumcondra Road, Drumcondra, Dublin 9 
  • Mystic Picnic (delicatessen), Main Street, Roundwood, Wicklow

One Prohibition Order was served under the FSAI Act, 1998 on:

  • Mr Ivan Ebbitt (unapproved food premises), Erne Hill, Belturbet, Cavan

Commenting on the high level of Closure Orders served in May, Dr Pamela Byrne, Chief Executive, FSAI warns that the legal onus is on food businesses to act responsibly and ensure that the food they serve and sell is safe to eat at all times.  She states that every Closure Order undermines the confidence consumers should expect to have in the safety of the food they eat. This has negative implications not only for the premises involved, but for the wider food industry.

    “Most food businesses follow high standards and are compliant with food safety legislation.  However, inspectors continue to encounter cases where consumers’ health is jeopardised through a failure to comply with food safety and hygiene requirements,” says Dr Byrne says.  “There can be no excuse for such breaches and negligent practices. They are avoidable when food businesses have proper food safety management systems in place.” 

Dr Byrne urged food businesses to take full advantage of the information and support provided by the inspectorate and the FSAI to ensure that they have the correct food safety management systems in place. Details of the food businesses served with Enforcement Orders are published on the FSAI’s website.  Closure Orders and Improvement Orders will remain listed on the website for a period of three months from the date of when a premises is adjudged to have corrected its food safety issue, with Prohibition Orders being listed for a period of one month.
