Termination of Anti-Dumping Measures on Imports of seamless pipes and tubes from Croatia



Following a proposal of the European Commission, the Council of the European Union published yesterday its decision to terminate the anti-dumping duties of 29.5% imposed in 2006 on imports of certain seamless pipes and tubes (SPT) from Croatia.

This decision was taken after an investigation carried out by the European Commission concluded that the situation regarding imports from Croatia warranted the termination of the measures. In its assessment, the European Commission took into account the situation of the sole producer of SPT in Croatia.
Background
The European Union industry had submitted an expiry review request that met all the legal requirements. The request was lodged within the foreseen deadline and contained sufficient prima facie evidence pointing out the likelihood of recurrence of dumping and injury should the measures against Croatia, Russia and Ukraine lapse. According to EU anti-dumping legislation, the European Commission had to open an expiry review investigation to examine all the facts. Throughout this investigation, the European Commission has ensured full transparency vis-à-vis the Croatian exporter.
The only Croatian exporting producer, CMC Sisak, ceased production in late 2011 due to its owner's decision to sell the company.
Conversely, the investigation concluded that the measures against exporting producers in Ukraine and Russia should be maintained.
