While it is too early to know if this has led to an increase in motorcycle accidents, bike-car collisions are going to happen.

"The General Assembly said lane splitting is legal. If you ride a motorcycle and you are obeying the law and are in a crash with a car or a truck, driver is responsible. Lane splitting of itself does not increase the frequency of wrecks according to a UC Berkeley study on the practice. The report looked at thousands of motorcycle crashes involving lane splitting. When the bikers obeyed the law, lane splitting was safe, the study authors said.

"That's the whole thing here. You as a biker obey the law and drive the way you're supposed to. Then some driver ignores the basic rules of driving and you're in a wreck," Zokaeem said. "They should be held accountable. We can hold them accountable. You can be paid for the pain and suffering you went through. Your medical bills can be covered."

Vehicle, or cage in biker slang, drivers are more often at fault in a crash than the biker.

"I've heard all the excuses. The most common is, of course, 'I didn't see him.' That just does not matter. A car driver has an obligation to watch the road and watch for everything on the road, not just other cars," he said.
