Florida mesothelioma victim awarded $14 million, but appeals may prevent him from receiving compensation

A Miami-Dade county jury has awarded mesothelioma victim from Sarasota, Florida over $14 million. The jury ruled that there was probable cause that the man developed peritoneal mesothelioma after being exposed to asbestos on the job in the 1970s.


William Aubin sued chemical giant Union Carbide for selling products that contained asbestos. Aubin believes he was exposed to these products while working for his family’s construction company, Aubin Construction of Key Biscayne.


Asbestos exposure has been linked to the development of mesothelioma, a rare form of cancer. Peritoneal mesothelioma attacks the lining of the abdominal cavity and organs. Aubin’s lawyers argued that he is “permanently impaired and will ultimately and unfortunately die from mesothelioma.”


Mesothelioma affects less than 3,000 Americans each year, and while there are palliative treatment methods available, including chemo, there is no known cure. The disease typically lies dormant for up to fifty years before an individual begins to suffer from mesothelioma symptoms, and the majority of patients lose their battle with this cancer in less than two years following diagnosis. Exposure to asbestos has also been known to cause scarring of the lining of the lungs and chronic respiratory failure.


Jurors at the trial also blamed four other corporations (including Georgia-Pacific) for causing Aubin’s illness. However, Bauta says that he expects Union Carbide to appeal the verdict, meaning it could be months or years before Mr. Aubin receives a penny.
